Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your access to and use of the Ascended website and the Ascended software-as-a-service platform (the “Service”) operated by Ascended Studios (“Ascended,” “we,” “us,” or “our”).
By accessing the website, creating an account, or purchasing a subscription, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. The product
Ascended is an AI-powered business operating system sold as a subscription. Each purchase provides one Ascended account for a single business to use tools such as inbox/conversations, Voice AI, Conversation AI, CRM/pipelines, calendars, funnels, marketing, reputation, and automations, depending on the plan selected.
Ascended is not a multi-tenant reseller platform. Plans do not include unlimited sub-accounts or white-label reselling rights unless expressly agreed in a separate written Custom agreement.
3. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for account credentials, for activity under your account, and for ensuring your use complies with applicable laws and these Terms.
4. Plans, pricing, and billing
Current plans and prices are displayed on our website (including Starter, Pro, and Custom). Prices are shown before checkout. Features included with each plan are described on the pricing page and may be updated from time to time.
Subscriptions renew automatically at the then-current rate unless canceled before the renewal date. Taxes may apply based on your location and will be shown at checkout when collected.
5. Payments via Creem (Merchant of Record)
Payments for Ascended may be processed by Creem (creem.io). When Creem processes your purchase, Creem acts as Merchant of Record / reseller of record for that transaction. That means Creem may handle payment processing, applicable tax collection and remittance, invoicing/receipts, and certain refund or dispute workflows related to the payment.
By completing checkout, you also agree to the applicable Creem checkout terms presented at purchase. Ascended remains responsible for delivering the Service you purchased.
6. Refunds and cancellations
You may cancel a subscription to stop future renewals. Cancellation takes effect at the end of the current paid billing period unless otherwise stated at checkout or in your customer portal.
Refund requests are reviewed case by case. Contact josh@ascendedstudios.com within a reasonable time after purchase and include your order email and reason for the request. Where Creem processed the payment, refunds may be issued through Creem.
We aim to respond to support and billing requests within three (3) business days.
7. Acceptable use
You agree not to use Ascended to:
- Violate any law or third-party rights
- Send spam, unlawful communications, or deceptive marketing
- Upload malware or attempt to disrupt or reverse engineer the Service
- Misrepresent your identity or affiliation
- Resell, sublicense, or white-label Ascended except as expressly authorized
- Use the Service for prohibited or high-risk categories banned by our payment providers
We may suspend or terminate access for violations, abuse, non-payment, or risk to the platform or other users.
8. Customer content and AI features
You retain ownership of content you submit to Ascended (“Customer Content”). You grant us a limited license to host, process, and transmit Customer Content solely to provide and improve the Service.
AI features (including Voice AI and Conversation AI) generate outputs based on your inputs and configuration. You are responsible for reviewing AI outputs before relying on them in customer communications or business decisions.
9. Intellectual property
Ascended, including software, branding, and site content, is owned by Ascended Studios or its licensors. Except for the limited right to use the Service under your subscription, no rights are granted.
10. Third-party services
The Service may integrate with third-party tools (messaging carriers, calendars, payment providers, etc.). Those services are governed by their own terms. We are not responsible for third-party outages or policies outside our control.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE uninterrupted service, specific sales results, or error-free AI outputs.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASCENDED STUDIOS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
13. Indemnity
You agree to indemnify and hold harmless Ascended Studios from claims arising out of your Customer Content, your use of the Service, or your violation of these Terms or applicable law.
14. Changes
We may update these Terms by posting a revised version on this page. Continued use after changes become effective constitutes acceptance of the updated Terms.
